That or he didn't want to deal with someone that doesn't have a lot of money to pay him. I have pictures of holes he put in the walls, drugs, alcohol. Pictures of him out drinking on the nights when it was his night to have her. I have witnesses from people that saw him be physically abusive. There are police records... dont know what more i need.

Do you have police reports that go along with the violence and drugs?
Do you have police reports from the physical abuse?



As far as the pictures of the holes in the wall, how can you prove that he did it?

Am I not proof enough? He pushed my mother into the door and the handle went through the wall. The other hole is from the phone he threw durring an argument and the third was his fist in the wall durring an argument. I have been keeping written documentation of our conversations. Yes the reports are from the physical abuse. He was arrested when he threatened me while holding my child. He has a criminal record of domestic violence, disorderly conduct and drug use.

No, you are not proof enough.



If he has no abuse or violence charges relating to the child, sole custody might be a tough road....and that is why the lawyer is telling you that it would be expensive.

So, punching holes in the walls and using drugs around her is not child abuse? Just because the child is not punched does not mean that a child should have to see that violent behavior. I know what he is capable of and I need a lawyer to listen and figure out a way to not let that happen to her. Do I have to wait until she gets popped in the face or drug through the house by her hair to do something? My goal here is prevention.

I googled and picked the first person. Had a consultation with him, and he seemed more mad about my situation than I was lol so I was on board.
He was great!

Do you have unequivocal proof that he is using drugs around her? Beyond your word?

It was his night to have her and i could smell pot wafting out of the house, so he would have been high with her if i hadnt taken her home. i called the police but i dont think they did anything. what would i have to have? a hidden camera set up and catch him doing it?

Does he have legal visitation?



If you show up at his house again, and there is the smell of pot coming from his house....call the police and wait for them to show up to take a report.

The first thing my lawyer had me do was make a lit of EVERYTHING I had ever witnessed him or know about him doing, pre baby and post baby.
Then he turned it into an affadavit, which came with us to court.
I accused him of doing heroin, coke, and pot and he accused me of smoking pot(which luckily I had quit and he just didnt know). So we both agreed to drug testing and he failed, I passed. From then on he had plenty of chances to quit, get help etc but he failed every drug test. Finally after like 3 months of random drug testing they stopped mine and court ordered him to detox and rehab.
He went and actually got clean.
In that time that he was failing drug tests though he only had supervised visits and at one point had absolutely no contact.
It's very possible t start off with just your word.

An affidavit can be built off of just what she is saying....however, an entire custody case can't be won based solely on that.

No it can't be won, I never said that.
If she could get him drug tested though, that could.
I immediately got full physical and legal custody the second he failed that first drug test.
Then he would have the chance to get help, which would be in the best interests of their daughter. Either way imo it's a win win.
