However-- since she was fine with having him there, and fine with drinking around him, and fine with doing sexual things with him (up to a point)-- it would be very hard to convict on the date rape.

Yes she tried to go to the police but they didn't do anything because they knew him. That's how the cops in that town are unfortunately.

Sorry but she should of know what she was getting herself into and be more responsible when getting wasted. No excuse or no need to play the blaming game. Yes is wrong but she consent it while drunk so I dont think it was sexual abuse or rape.

I think that whether it was or was not isn't even relevant. If she feels abused, she needs to seek counseling to help her cope.



The fact is however, that if she was drunk enough to lack the ability to consent to anal, then she lacked the ability to consent to the sex in its entirety. What I mean is that either the entire encounter was rape (because she wasn't able to consent due to being that drunk) or it wasn't. You can't say she was too drunk to consent to anal, but she was about to consent to oral/vaginal. Either she was able to consent or not. I go with no, but my stand on it is pretty firm. If a person is drunk, they lack the ability to consent and you should not have sex with them. Pretty simple to me.

Exactly. I told her whether she consented or not if she was as drunk as she says and in and out of consciousness (which is something she shouldn't have done being only 16) then he should've at least respected her enough to not have sex with her knowing the kind of condition she was in. I told her it was more of a matter of his character, judgment (as well as hers) and his respect for her more than anything.

If she is 16 she shouldnt even be drinking. Sorry but I just hate when little girls act like if they are grown and think that they can drink and then whine when something like this happend. That is just pittiful. Sorry if I am sounding like a b***h.
