My boss didn't give me time to read the handbook.. I asked her for a few days to read before I signed and she said it was just a paper saying I received it and she couldn't release the handbook to me unless it was signed.. I just realized it was in there today. And I know it's ridiculous to say they are controlling me.. I am getting a little frustrated as I have not had a cigarette since she had this convo with me around noon. So I didn't mean it.. It just sucks that it just comes up now.. I actually enjoy smoking. But I do enjoy my job more.

Quoting Blair Waldorf (SuperKink):" Actually she did. She signed the handbook, which states that she cannot smoke and work there. And if ... [snip!] ... it's his policy to hire non smokers, it's perfectly legal. It's not discriminatory because she has a CHOICE to smoke or not. "

I didn't see that post sorry

Quoting Stfu Squirrel:" Yeah, she could probably get unemployment if she was fired for smoking. That doesn't mean she can't ... [snip!] ... she can't get fired. And why would she have to sue for it? She'd qualify, simple. Where are you getting this expertise? lol"

I didn't know it was in the handbook to be a non-smoker so then it is legal. I am not an expert but I did go to school for Criminal Justice and had to study law, I'm not saying that I am an expert. I was just saying it is illegal to fire because of smoking, being fat, pregnant, ugly, woman, man etc. So if it wasn't in the handbook then they can sue for discrimination but I just went back and read that it WAS in the handbook to be a non smoker.

I'm confused, does the handbook say you can't work there if you smoke AT ALL? Or does it say you can't smoke there, on the premesis? Cause that's a big difference lol

LOL cancer free? My friend's husband never smoke and is battling Leukemia. Just because you don't smoke doesn't mean you will be cancer free or live a long life. Plenty of people do not smoke and die young for other causes such as suicide, murder or accidental overdose etc.

I'm sorry, do you need the FULL legal disclaimer? "You'll live a long LUNG cancer-caused-by-smoking-free life, barring no other bad things happen to you early on." Is that better for you?

You knew what she meant :? Statistically, smoking makes you considerably more likely to develop lung disease. Hardly comparable to suicide or overdose.
Not smoking is much healthier in the long-run, obviously. Don't be intentionally obtuse.

I was half kidding and being.mildly sarcastic..half my family has died from cancer so I'm very well aware but it's a known fact smoking greatly increases your odds of cancer, decreases your quality of life and kills you quicker...It's just s no brainer to me..

If you had no intention of not smoking, why on earth would you take a job in an office of a doctor that specializes in helping people quit smoking?

Having someone who is an active smoker employed and dealing directly with people who are trying to quit would discredit the doctor. I think it makes complete sense that he not hire or retain smokers.

No it isn't.
Read up on what "at will employment" means. Ohio, OP's state, is an at-will state. Florida is too.

Basically, they can't fire you for the following reasons:

-filing a workers

They do not specialize in smoking cessation, it's just a program they offer, when I got hired they didn't even offer the program yet. I just went through the handbook and the policy for tobacco just says no smoking In the office or within 20ft of the entrance. She was making it seem like there is a no smoking at all policy. I
Haven't smoked since noon yesterday. So it's a start, but idk if they can really fire people for refusing to quit smoking if there is no policy for it.

Yes maam they can, if your state is indeed an at will state like someone above you mentioned. Honestly, its great you're trying to quit and i do think the e-cig would be beneficial to you if you have trouble since there's no smell. Good luck! And congrats on being smoke free for almost a day!
