So my son is almost 5 months old, I want to get child support.. his dad hasn't been there through the whole pregnancy nor has he been here for his son. I know I should of done this WAY sooner, trust me I know, but my dad has big problems with it and for some odd reason doesn't wont me to do it, I know its my decision but idk, at the same time I want to respect him, im just too nice lol, but I know this is the right thing to do, I need money for my son, and we both made this baby, not just me..
anyways, my baby daddy doesn't work. he works under the table, but not every day. his dad works on peoples cars and jerry (his name) just gets paid whenever he works, like not even 50 dollars half the time. if I were to go for child support would they make him pay, or not, with him not having a job? or would they make him get a job? he is 17, he dropped out of high school. so I'm not sure what they would do. thanks for any answers!

For me, they set up a basic amount of $400 a month until he sent in proof of income.
So if your BD tells them he has no income then they will adjust it but you can tell the court that he makes money on the side.

They would give him a certain amount of time to get a job and start paying. If he didn't he would go to jail. When he got out he would be given a set time to find a job. When he gets a job he will have to pay a percentage and if he doesn't he will go to jail.

They can't force him to get a job, just like they can't force him to keep one once Child Support starts coming out of his check.

IDK about where you live, but my father would have to go to jail for not paying his child support. And my mom was still collecting it until I was 20 years old. She and my father finally made a deal bc he owed her $26K in back CS. So he filed is back taxes and current taxes and she got the money.

Oh wow, they don't do any of that in California lol

it's worth a shot, but my advise is do it now. It's pointless to go years with out and then come out of the wood work demanding it. If you all play nice now it just makes it so much easier in the long run.

that's true! I should of done it before, I guess I just thought he would eventually come around :/ I had actually even given him a chance to just either A. bring the stuff I need (some wipes, pack of diapers, can of formula, etc) or B. just bring me some money so I can get it myself. He was always like yeahhhh I will!! but it never happened. I guess it would be the right thing to get it actually written down and ordered by the court anyways! so I'm going to do it, I don't wont to wait any longer on this!
