grandparents rights do not apply when both parents are alive and married.

In FL they do. Because we are separated she can sue for grandparents rights. I won't get a divorce because he lives with her and the lawyer already told me that he is guaranteed shared custody which I find complete bullshit seems he has never been there and has witnessed all of the things his mother has done to me and DD and never said a word. As for assault charges I didn't file any because there were no witnesses other then my husband I knew they would try to turn it against me.

In your custody agreement you can specify that you do NOT want your child anywhere around her.
You need to contact a lawyer, maybe even a few lawyers. Tell them your dilemma and get their opinions. They will be a lot more helpful than us lol

This Lawyer says Grandparents don't have rights in Florida. I'll try to find an actual Law code, but I'm leaving in a few minutes, if I can't find it before then I'll do it when I come back.

Still haven't found a code, but I will later. But every single site I'm seeing says that Florida has the strictest Grandparents Laws in the country. It's bordering on impossible for a Grandparent to get them. They have to prove they've stood in place on the Parents on several occasions.

She can only get rights if she can prove you to be an unfit parent or if she can prove that the child would be harmed with out her in the babies life. Due to her psychotic nature I seriously doubt any court would ever give her rights if you can show what's up, like next time you're around her document everything she does. Your phone can become a recorder, download an app. That way you can record what is going on and don't have to worry about not being able to refute it. You also need to press charges no matter if someone saw it or not. They can prove it by looking at your face if she hits you again.

I took pictures of all of the bruises for if I felt a need to apply for a restraining order. I talked to him again and got him to yet again to agree that his mother is not to see her. If he keeps pressuring I will get the restraining order. Thankfully I have TONS of witnesses that can prove she is a psychotic person and unfit and a human being let alone to be around a child.

I would if it was in your child's best interest but its NOT. I would never let her see your daughter ever again. No matter the circumstances.

I'm from FL. It's next to impossible here to get grandparents rights.
