Ok so this is a funky situation. My husband has custody of his son. When him and his ex wife got together, she had a very young son who only knew my husband as daddy. Well when she left him, she left both kids and even after the divorce he had their son and his 'former' step son. She came and got them after 1.5 years because he was deploying and we wanted to give her a chance to see the kids. He will be coming home in a few months and when he does we will be going to get them back because they both want to come back. My only concern with getting his step son is that because he has no custody or any form of legal rights to him, will we be able to get him enrolled in school here in Georgia?

You probably shouldn't have a problem. I never had to show Birth Certificates to get my kids registered here. If you don't have to show that then there's not really any way they'd know he wasn't the Bio Father.

It depends. My mom had a really hard time registering me for school because we don't have the same last name. We also had a hard time withdrawing me from school, my step dad couldn't do it nor could my grandma, whom I was living with. It HAD to be my mother.
