Driving on suspended is a much worse charge than driving without a license.

Driving without a license is the same ticket you get when you leave you'd ID at home.

Any crime is jailable. A ticket is technically an arrest. But it's not that big of a deal. And yes, they're the same charge.

Ugh. You don't know much about the law, do you?

Quoting 3 little monsters:" Really? I once looked up the jail where I grew up, they had records, pictures and offenses listed but ... [snip!] ... when I was arrested for a misdemeanor possession charge. LOL It's not even on my record anymore but still listed there! LOL"

Yep, unless I'm missing something lol.
It just says the court case, the result, etc.
The only jail information you can get for MD is for sex offenders. You can look up current inmates and those recently arrested.

Start now. It took me almost 6 months. Start with getting a job and LO into daycare so you are financially independent.

Doesn't matter if you're drunk or not if you're underage. You're drinking illegally, AND driving illegally. You're fucked. At least in indiana.

A breathalyzer is generally in admissible in court, while field do every is. There would need to be probable cause to initiate either and a beer isn't going to give that....unless he bathed in it. And again, unless he broke a law, he couldn't be pulled over.

A lot of people speed, and do other stupid shit while driving. Especially teenagers. And smelling alcohol on a teenager's breath is probable cause in itself. And he's already breaking the law by driving with no license, which could give them probable cause to search the car and breathalize him too.

Make all of the excuses in the world, what her SO did was extremely irresponsible and could have landed him in jail. Even if for just a night.

1 beer does not make anyone drunk.

Unless the cop is psychic, he doesn't know he's unlicensed and and driving, this couldn't pull him for it.

Being an unlicensed driver is NOT probable cause to search a vehicle.

Alcohol on the breath is probable cause to issue field sobriety. I highly doubt 1 beer would cause someone to wreak of booze.

And clearly he did just fine driving after his ONE beer.

Obviously. But if he was speeding and got pulled over, then he might get into some shit.

Driving a car illegally does indeed give them probable cause to search your car.
Especially considering he is underage. One beer can indeed make your breath smell of alcohol.

I'll easily trust the legal advice from my brother who's a police officer and my uncle who's a well respected lawyer than someone who clearly knows nothing of the law.

You should actually talk to them. Driving without a license is not PC to do S&S.

Doesn't mean they won't. Especially with a teenager.
They can say the car reeked of pot, and that's probable cause. They can say anything they want, who's a judge going to believe, a 19 year old who was drinking underage and driving with a license, or the police officer?

So now you're pulling the corrupt cop card? Your brother and uncle would be so proud.

What? My brother's seen people driving that he knew were fucked up, and said he smelled drugs so they could search. He's always found something.

And my uncle told me these stories to convince me not to carry pipes in my car in high school.

They work in law. They know not everything goes by the books. They aren't so naive.
