It's probably legit.



I had a friend that tried to commit suicide one evening. The next morning (while she was in the hospital), her husband went to the court house and filed for an order of protection for himself and their children. It was awarded immediately.



She wasn't able to see or speak with her kids for several weeks after that.

The only time I've heard of someone getting emergency custody it was done that quickly. The child stays with the parent who filed til there's a real custody hearing.

If i were her I would go to the courthouse and file right now. If hes just bullshitting then shes covered. If hes done it she will find out.

He could have, yeah, but until she is served with papers that say so, then I would be cautious about what she believes.

So then it is possible but not likely unless he had some kind of evidence against her? She's still at the courthouse now, if he was granted emergency custody, what's her quickest recourse?

If there is a custody order in place, she needs to maybe file to change it. If not, she needs to file for custody.



If he has the order and she hasnt been served, she only has time before they get her the paperwork and then the child has to go with the dad :(

If theres suspicion of drugs, either one can ask the court that the other parent or both are drug tested regularly....



My ex tried to pull that on me. I dont do drugs though and the judge knew it.

Update: she found out that when he went to file they denied it and then he went nuts so now she's filing for emergency custody.
