She breached the lease with us over a dead tree in the front yard that she claimed we needed to pay to remove. Per the city the tree is her responsibility so when I sent her a letter to remove in 10 days she wanted to inspect the house then told us we needed to leave. Now she wants damages yet she breached the lease.

First of all, the tree is not your responsibility. It's not your property, it's hers... but why did YOU send her a letter telling her to remove it from her own property? .

Second, what were the damages she is claiming? Did you take pictures? Did she see something that would make her call?

Third, have you documented any of this?

I sent her a letter because she got the same violation letter that I got. But she sent it to me after the time frame to remove. I called the city inspector and asked him what about her being the landlord and he said send her a notice to remove then for health and safety.



She claims to have seen drug equipment which the only thing she could have seen was my Hookah which all should know is not drugs.

WE know it's not drugs... but to her "older" or "square'r" eyes.... she may have instantly thought bong. But you should be able to test clean, so dont worry. Keep copies of the letter and let CPS know you're involved in a dispute with your old landlord. How long did you live at the property?

1.) Sometimes there is a provision in the lease that requires the tenant to do all yard work and maintenance, if this was in yours you were responsible. If it wasn't she is responsible.
2.) Did she give you an actual eviction notice or just tell you to leave? If she legally evicted you that means you were found (by a judge) to be in breach of the lease agreement. If you left w/o an acutal eviction you are in breach of the lease.
3.) Landlords are allowed to inspect the property as long as 48 hours notice is given. Failure to allow it can also be a breach of your lease agreement.
4.) What did she find when she inspected the house? Were there holes in walls? Excessive filth? Is there any reason she had to think you were being neglectful or that your child was in danger?

Also how do you know it was her that called? They are not allowed to disclose who gave them the info and unless they believe that they may need more info from the tipster they do not even take names or phone numbers.

Its obvious who called. Tells us to leave. we do.
She files a lawsuit now and is trying to find us to serve up.
Then CPS. It's obvious.



Surprise to her though I have been in the legal field for 8 years. I will be going back after her.

I agree.
The two women involved in my case were very nice, and you could tell that they wanted to make sure everything was okay. They spoke with my daughters doctor and kept me posted the entire time.
They came to my house numerous times... and the one woman even showed up months later to let me know that my case was cleared and it wasn't on any record that they were called.



I suppose some people run into instances where the case workers are miserable or just awful people. But that doesn't mean that every case worker is like that, or doesn't care.

Here they allow you the option to give your information, or remain anonymous. I asked who called and was told that the only time they could give me any of that information was if the person called more than 10 times in a certain time period, claiming ridiculous things even if the charges were never proven.

I called on the girl a couple houses down because she'd use a child leash to tie her 2yo to the porch and put his 1yo sister in a stroller next to him, then go upstairs for 30-45min to get ready and then finally come out and go down the street with her kids... happened 5-6 times a week. The same girl came into the CVS I worked in with the 2yo boy and he ran outside, so she said his name one time, and then "dios mio" and didn't move an inch until I cam around the counter to go outside and make sure he was okay :roll: Nothing happened to her. She still does these things but they're 2 and 3yo now.

yes, my daughters sorry ass sperm donor cried to his b***h grandma, who babies him gives, him money and stuff. he dosen't t pay child support he cried to her and told her i don't let him see her and made up things to cps. yea they came one time and never contacted me again yet i called to see whats up still nothing

So CPS showed and of course everything was fine. CPS worker thought it was quite funny the stupid accusations she made.

I've had cps called on me 6 times in the last year. I think it's BD1's dad being spiteful because i haven't let him see DD1 in years.



Every time they just come poke around the house, talk to be, talk to DD1, and close the case.

I think it depends on what your landlord claims is going on.my step mom called CPS on me claiming my kids were being beat everyday,i was Starving them and they were skin and bones,my husband beat me and i beat him,and the list went on.when cps showed up he walked around my house to look for safety hazards Looked in my Kitchen to make sure there was food,i had to undress my kids so he could check for marks and bruises,and talked to everyone in the house including my kids.after he saw that my kids were healthy and not in any danger he said he was closing the case.My step mom wasnt to thrilled about that =/ she has been trying to get them ever since.

Yah all he did was talk with me and my Fiance together. He did separate interviews but while we were both in the room. Then he said one last thing. I need to see the childs food and room. He pocked his head in the pantry where his food is kept then pocked his head in his room. Then said he is going back to the office to get the case closed.
Should be about a week to 2 weeks before they have a final report for me and a letter mailed out confirming the case was closed.
