It would depend on SO much. WHY the niece/nephew was living with us, how old the niece/nephew was, what the issue was, who was at fault, how stable my relationship was with my man, etc.

I would choose my s/o. I love my niece and nephew dearly, but I would rather never see them again vs. never seeing my s/o again.

Pending the fact dh wasn't a child molester, drug addict, or physically abusive then my niece or nephew would go. I am sorry but I made a commitment to my dh and unless the above things would to occur then I am sticking to those commitments. Though I really don't think dh would ever put me in that situation. If My sister were to die after having kids he would be more than willing to raise them along side our own no matter the issues they might have. He is a good man like that.
