Should he have to pay? Madi's*Mama Due November 2; 1 child; Holland, Michigan 7391 posts

So this came up on Judge Judy lol
This couple splits and have 2 sons. The original custody agreement said the boys were with the mom one week, the dad the other so no child support was put in place since each parent was responsible for supporting the kids when they had them. I missed the reason why, but for some reason one of the sons went to stay with the dad full time and the other boy stayed with the mom. After a while, the boy with the mother got in trouble and needed an ankle monitor and the mother felt the dad should have to pay half the cost. Judge Judy ruled that would fall under support and since the son was with her when he got into trouble and she was the one responsible for supporting him, she was fully responsible with the cost. Do you agree or do you think because it was a bigger expense they should have to split the cost? It came up that they split the cost of the other boys braces and that's why the mother felt they should split this cost as well.

*i missed parts of this episode so if you watched it and I got info wrong please let me know lol*

If they split the huge cost of braces, they should split the other big costs as well.

I believe if they split the costs of big purchases for one child, they should be consistent with all unavoidable and big purchases and split those.

IDK... sounds like mom supports the one child, dad supports the other child. I guess I agree with Judge Judy.

so the dad supports one kid and the mom supports the other yet the dad should help support the kid that doesnt live with him??

no. if thats how she wants to be then she should pay half of the other kids stuff.which would be completely pointless imo

They split a big expense for the kid that dad got.
She helped dad pay for braces for the kid he kept.

Even though she paid for half of the cost of braces for the boy who lives with dad?

In that case I think he should pay half. Or at least reimburse her for why she paid for the braces.

No.

Braces are out of parents control. That's a health expense. A bracelet happened because of his actions, which she was in charge of him when it happened. One had a clear cause that was possible to avoid, the other did not.

The Dad isn't at fault for the kid needing braces. The Mom *IS* at least partly at fault for the child she had getting into trouble.

The question is, was the monitoring bracelet "unavoidable?"

Braces happen because it's a medical need. The kid got in trouble and was punished, while on Mom's watch. Seems like it would be her job to pay it then. I mean, since when is getting in trouble and being punished something that is "unavoidable?"

I never thought about that. That's a really good point.

Braces aren't really a NEED. It's not a necessity to have your teeth fixed, and it's a possibility that the child may have inherited bad teeth from the mother or her genetics. I know some people with some pretty bad teeth and their kids had the exact same teeth so there has to be some sort of genetic traits for teeth.

I NEEDED braces as a child because I couldn't bite down properly. If I hadn't gotten them, I would've had jaw problems.
