That's not really fair to pick on him for (imo) some people are deep sleepers and it's not his fault.

he does it out of laziness. he can wake up he is not a deep sleeper. i couldnt get him to watch her so i could go to a 1 hour apointment when we were together. he woulnt feed her or bath her unless i told him to.

Really? I don't know what state OP is in (didn't look) but in Georgia it's admissible in court as long as one party knows about it.

I am in WV too.



OP is right, only one person in the conversation has to be aware they are being recorded for it to be used in court.



I have a horrible ex too, and he has two other mothers of two other children and I have two with him. It is a mess. He is not fit, they are not fit, but the sad thing is, there is no law against being a shitty parent or not wanting to really be one, or having shitty individuals around your child either. There is nothing you can do but document everything you see, hear, or know and pass onto your lawyer. Your lawyer will tell you what is pertinent and what is not.



One thing you can do, however, is ask that parents and/or family members are the only people allowed to pick up/drop off or be used for transportation in your custody agreement. That may solve the you don't want her driving issue.

Really? Because I think it's unfair that her poor daughter is awake unattended whilst her father sleeps!
She could get hurt in the time his spending asleep

If there needs to be someone there to watch him watching her surely that would tell the courts that he's an unfit father and needs proper supervision and maybe a parenting course
