So my ex husband has had a rough few months and has found himself in jail facing felony charges. This throws a huge wrench in my plans. I'm getting married at the end of this month and we are planning on moving to take jobs in Houston, TX (roughly 10 hours away). We were writing up the paperwork with our attorney when I found out that my ex was in jail and it could be months before he even sees trial. 

What do I do now?! Will they let me modify custody with him being locked up? Do you ladies think I'll be able to go ahead and move or will this screw up everything? 

My attorney is out of town until Monday and I'm getting frustrated thinking about this! :(

When my brother was in jail, they just took him to court dates that he had regarding custody. I don't know if it's like that everywhere though...

I'm assuming that's what will happen here. He's in a different county, almost 2 hours away, is my biggest concern. Hm. Hopefully the lawyer gets back to me quickly!

I know in some states incarcerated parents can still receive visitation while in jail as long as it doesn't bother the child. So I am sure if they are able to gain them rights there is some way to get a conference or agreement while he is in there.

I think they'll just have to transport him to your county for court anyway. I hope everything works out!

That would be preferable. I don't want to screw him over or hurt him. This was going to be a pretty agreeable move. I'm really worried about where his head is right now and if he will think clearly enough to make sure we reach an agreement that he is truly okay with.
